The short version of how Referral Market works and what each side agrees to.

What Referral Market is

Referral Market is a place where a business posts what it will pay for a referred customer, and a connector who sends that customer is paid the fee once the business confirms the referral.

Referral Market is not a party to the sale between a business and its customer, and does not employ connectors. A connector works for themselves, as an independent contractor, not as an employee or agent of Referral Market or of any business.

You must be at least 18 to list a business or to join as a connector.

Your local laws

Check your local laws and regulations before you pay or accept a referral fee. Rules differ by state, by city and by industry, and some licensed fields limit or forbid referral fees. Your employer or the platform you work through may have rules of its own.

You are responsible for following the rules that apply to you. Referral Market does not give legal advice and does not promise that a listing is lawful where you are.

Businesses

You set the fee and the terms of each listing, and you may change or pause a listing at any time. A pass keeps the terms it was created with.

You confirm a referral only when the customer did what the listing asks, and you decline it with the true reason when they did not. Once you confirm, you owe the fee.

An answer cannot be changed by the business afterwards. If one was given by mistake, or a connector believes an answer is wrong, either side can tell us through the contact page with the pass number. Referral Market looks at the pass's record, may ask both sides, and can reopen the pass until it has been billed. Reopening sets the earlier answer aside and the business answers again; both answers stay on the pass's record, where the business and the connector can see them. Once a pass has been billed, a correction is made as a credit or charge on a later bill instead.

When the outcome is not known at the door, you can mark the customer as arrived and answer later: within thirty days of the arrival, or of the pass's expiry if that is later. We remind you while it waits. A pass not answered by then can no longer be answered, carries no fee, and counts as unanswered on the record connectors see. A pass that expires without the customer being marked as arrived can still be confirmed for thirty days after it expired, if the customer came in time.

If a listing offers the customer something, such as a free appetizer, you honor what the pass shows when the customer presents it.

You are responsible for what the people on your staff list do in your name.

Connectors

The customer chooses where to go. You recommend a business only when it suits what the customer asked for, and you never pressure or mislead them.

If a customer asks, you tell them that you may be paid for the referral. Where your employer's or platform's rules, or the law where you work, require you to say so without being asked, you follow them. You create a pass only for a real customer, and never for yourself or for a business you own or work at.

A business can enter your connector code when it joins, or before its first confirmed referral, if you told it about Referral Market. You then earn the introduction bonus described under Fees and payment. A business cannot enter the code of a connector account its own owner holds.

A note on a pass holds only what is needed to tell the pass apart, such as a party size or a first name. You do not put a customer's phone number, address, or anything they would not want written down in a note.

Fees and payment

Listing a business and joining as a connector are free.

At the end of each week a business is billed for the referrals it confirmed that week: the referral fees, plus a service fee to Referral Market of 10% of the referral fee or $3, whichever is more, on each confirmed referral, added on top of the referral fee. For example, a $20 referral fee costs $23 in all, and a $50 referral fee costs $55 in all. The service fee is shown on the bill.

Connectors are paid weekly. Each weekly payment covers the confirmed fees whose bills the business has paid by then. A fee whose bill is not yet paid is not lost: it is paid in a later week, once the business pays. Referral Market does not pay a fee before the business has paid it.

A connector whose code a business entered earns an introduction bonus: a tenth of Referral Market's service fee on every referral that business confirms in its first year, counted from its first confirmed referral, whoever sends the customer, paid once the business has paid its bill. The bonus comes out of the service fee, so the business pays nothing more. It is paid in the same weekly payments.

Payments are handled by Stripe. A business pays its weekly bill by card or bank through the link Stripe sends, within seven days. A connector is paid to their own bank account through a Stripe account they set up from their Earnings page, where Stripe collects the bank and tax details it needs; by setting it up, a connector agrees to the Stripe Connected Account Agreement. Referral Market does not see or keep card, bank or tax identification numbers. You are responsible for any tax on what you earn. Where the law requires it, a tax form for what Referral Market paid you is issued through Stripe.

Accounts

Each business and connector is reviewed before its account opens. We may decline an application, remove a listing, or close an account that breaks these terms or that we believe is being used dishonestly. Records of passes already created are kept.

You may ask us to delete your account at any time. The privacy page says what is removed and what is kept.

No guarantees

The site is provided as is. We do not promise that it will bring a business customers or a connector income, or that it will always be available.

To the extent the law allows, Referral Market is not liable for losses that arise from a dispute between a business, a connector and a customer, or from the conduct of any of them.

Changes and contact

If these terms change, the new version is posted here with its date, and a change that matters to you is also announced on the site before it takes effect. Using the site after that date means you accept the new version.

If any part of these terms cannot be enforced, the rest still applies.
